Pro Bono Practice at NK+MNK+M encourages all of its attorneys to provide Pro Bono legal services each year. Towards that end, NK+M has entered into agreements with the Disabilities Law Center of Massachusetts and the Disabilities Rights Center of New Hampshire, both non-profit organizations dedicated to the full and equal enjoyment of legal rights by people with disabilities in such areas as employment, housing, assistive technology, special education and medical or financial assistance. We also work with the American Bar Association Death Penalty Representation Project to provide representation to indigent persons who have been convicted of capital crimes and are awaiting execution. Our attorneys may also choose to take on Pro Bono matters for other individuals with limited means or for non-profit civic community or religious organizations. The Disabilities Law Center and the Disabilities Rights Center refer appropriate cases to NK+M, which then takes over case handling with guidance and mentorship provided by the referring agency. The firm’s Pro Bono Practice Group provides ongoing monitoring for the cases to ensure the highest quality representation, provide training as necessary and foster a collaborative approach to this work. As part of NK+M’s work on behalf of persons with disabilities, our attorneys have litigated cases challenging the reduction or denial of services and medical devices under the Medicaid law. In this vein, we have fought reduction in funding for private nursing services, obtained Medicaid coverage for experimental treatment for a client with severe OCD, and challenged the denial of coverage for a functional electric stimulator device to help a client with multiple sclerosis regain the ability to walk. Our work with the Death Penalty Project has taken us away from our home base in New England. States generally provide representation through the trial and initial appeal of a criminal case. However, indigent persons sentenced to death are frequently unrepresented after the initial appeal. Our work seeks to ensure that such persons have effective representation in asserting collateral challenges to the conviction in the post appeal habeas corpus process. As a firm we do not take a position on the propriety of the death penalty in any jurisdiction. However, we have committed our time and resources in the belief that persons subject to the death penalty are entitled effective representation. NK+M is committed to using its member’s skills and talents to work for the public good and to provide adequate services for some the least powerful members of our community. We believe that recognizing our responsibility to engage in public services in this way reflects the value of all firm members. |
