Environmental

Regulation of the environment and access to natural resources, and exposure to pollution and environmental conditions, command a prime place in the public eye. That attention makes this field of law uniquely susceptible to legislation and targeted enforcement by local, state, and federal regulators. The lawyers in our Environmental and Toxic Tort Litigation Group have the knowledge and experience to guide clients through these obstacles. Their experience comes from handling a wide variety of cases involving important issues in this field.

In addition to knowledge of the applicable laws, a successful working relationship with the officials responsible for enforcing them is crucially important to a client's case. Our attorneys have developed those relationships. They start with the right credentials. They then demonstrate their personal commitment to this field through community involvement and leadership. Finally, they are known by their continued study and frequent lecturing in the area. These qualities and accomplishments give them the credibility necessary to advance a client's goals.

In handling these cases, our lawyers also draw on:

  • An understanding of complex environmental and toxicological science.
  • A knowledge of how regulatory agencies seek to enforce statutes.
  • Relationships with a network of nationally recognized experts in the field of environmental engineering and toxicology.

Our courtroom skills enable us to present complex factual evidence and legal concepts to either administrative bodies or juries in an understandable and persuasive manner. Above all, however, our lawyers work to develop and implement a plan and budget that will accomplish the client's goal most efficiently and expeditiously.

Recent representative tasks in this area include:

  • Defending a corporation in a multimillion dollar environmental clean-up suit from claims that it should be considered the successor-in-interest to the company responsible for the environmental harm.
  • Representing a growing New Hampshire municipality in negotiations relating to the allocation of Superfund liability for a municipal landfill site.
  • Representing insurance carriers regarding toxic tort and latent injury insurance coverage issues arising from the presence of lead paint.

Our lawyers have the required skill, knowledge, and experience to successfully guide clients who face regulatory or litigation challenges throughout the environmental field, including the following areas:

  • Aquifer containment
  • Heavy metal, groundwater, and MTBE contamination
  • Hazardous waste regulation
  • Wetlands regulation
