Paul is a senior attorney in our Boston office. With over twenty-five years of experience, his practice has focused on the defense and counseling of clients in complex civil litigation. Mr. Milligan draws on his extensive litigation and mediation background to advise clients in our Construction Industry and Energy & Utility Groups on contract interpretation, project management, code compliance, and cost-efficient resolution of disputed claims. Those clients find Paul's practical approach a valuable resource to guide their business decisions. He has tried cases in both state and federal courts.

Recognized for his courtroom experience and judgment by his peers, Paul is AV rated by Martindale-Hubbell, its highest rating for ethics and legal ability. He is a founding co-chair of the Construction Law Committee of the Massachusetts Bar Association. Paul is also an active member of the Associated General Contractors of Massachusetts. Mr. Milligan also served as Co-Chairperson of the Tort Committee of the Boston Bar Association for two years. Paul has also been a recognized legal expert by Massachusetts Lawyers Weekly.

Paul is a published co-author, including annual construction law updates and New England Claims Handling Practices. Recently, the American Bar Association published Paul’s article on “Who Decides the Arbitrability of Construction Disputes,” featured in its April 2011 The Construction Lawyer publication. Using this article as a platform, Paul has been invited by the AAA to teach arbitration law advocates what they need to be aware of when handling construction cases.
Paul has been a frequent speaker and panelist for both Massachusetts Bar and Boston Bar Association presentations, and a guest speaker at various seminars, including most recently Legal Issues for Massachusetts Professional Engineers (Halfmoon Seminars). Paul Milligan was also recently one of a select group of Boston area construction industry attorneys invited to participate in a roundtable discussion with the American Arbitration Association on Construction Dispute Resolution: What is Working and What Needs to Change.

Paul served on his town’s Finance Committee for five years, one year as Chairman, and has served on other local Boards, town committees and groups. He has also served as the Moderator Pro Tempore on numerous occasions during the last several years, most recently during the May 2011 Annual Town Meeting. Paul received a B.A. degree in the Economic Honors Program from Duke University (1983), and his J.D. from Boston College Law School (1987).
Representative Matters include:

• Represented the general contractor in $25 million dispute arising from significant schedule impacts and delays
• Represented the subcontractor in a $27 million arbitration claim brought in London involving the design and construction of an LNG terminal in the United Kingdom
• Represented the engineering firm in its claim to recover cost overruns in the design of a biotech facility
• Represented the engineer in $6 million claim involving the Owner and general contractor relative to a fresh water treatment plant
• Represented a general contractor in construction and design claim involving wrongful deaths during renovations to a building
• Represented a general contractor in arbitration claim involving the retrofit of two large boilers located on a federally-owned arsenal
• Represented a public authority and the Construction Manager in a contractor’s claim for damages, and the applicability of the Project Labor Agreement
• Represented a utility in claim for three wrongful deaths and significant injuries to surviving mother and children
• Served as local counsel in 28 U.S.C. §1782 Applications for Discovery for an $8.6 billion judgment entered in Ecuador, and involving claims brought before an international panel of arbitrators presiding in the Permanent Court of Arbitration in The Hague
• Represented a subcontractor on a claim against the surety for work performed on a waste water treatment plant
• Represented the Owner in extensive property damage claim to “one-of-a-kind” artwork and other treasures resulting from renovations to adjacent property
• Represented a utility in property damage and personal injury claims when one floor of a commercial building under renovation “blew up” following the accumulation of natural gas
• Represented a products manufacturer in a three-month trial over $35 million dollar property damage claim that ended in a defense verdict
